Copyright protection and digital transmission

The development of new technologies has gone beyond the doctrine on important issues prescribed in copyright law. The doctrine deals with what works are protected by copyright law, what constitutes copyright violation, and who owns copyright that has been made. The digital transmission raises new issues on the right of information producer and the relationship between copyright holder and publisher in case publishers transform literary works into digital works. Copyright law provides relations between producers of content and the authors, artists, computer programmers, and others who actually create the content or works upon which artistic products, computer databases and web sites are based. The Indonesian Copyright Law, which is Law No. 12 of 1997, does not touch Cyberspace. The law, however, prescribes transformation of works. According to this law, transformation of work is protected as another work without undermining the original work. By virtue of the provision, the issue on the relation between producers of content, the authors, computer programmers and publishers will be properly addressed in the contract entered into by them.
